INFORMATION SERVICES - OFFER

This Offer Agreement for the provision of information services (hereinafter referred to as the Agreement) defines the relationship between PHUKET 24 ONLINE CO., LTD. 96/7 Moo 7, Soi Saiyuan, Rawai, Phuket, 83130, hereinafter referred to as the Contractor, and The customer who accepted the public offer (offer) for the conclusion of the Agreement.

1. The Subject of the Agreement

1.1. The Contractor undertakes to provide the Customer with information services selected by the Customer from the List of Information Services (hereinafter referred to as the List) posted by the Contractor on the Internet at globeestate.net (hereinafter referred to as Information Services), which is an integral part of this Agreement. The customer has the right to choose any package of paid information services.

1.2. Information services are provided by the Contractor in the form of providing the Customer with a software and hardware complex of solutions for the Customer to place his real estate objects on the basis of the selected paid tariff.

1.3. Information services are provided on the terms of the full consent of the Customer with the provisions of this Agreement.

2. Conditions and procedure for the provision of information services

2.1. Payment for services under this agreement is carried out by the Customer on the terms of 100% prepayment.

2.2. Access to information services is provided to the Customer after fulfillment of payment obligations.

3. Rights and obligations of the parties

3.1. Rights and obligations of the Contractor:

3.1.1. The Contractor is obliged to provide information services in a timely manner in accordance with the deadlines established for the relevant information services on the Internet at the addresses phuket24.online

The Contractor has the right to change the date and time of the provision of services if it is impossible to provide services within the time limits established by this Agreement, including in connection with the maintenance or repair work on the website. The Contractor notifies the Customer about the change in the terms of the provision of services by placing a corresponding notice on the Customer’s e-mail.

3.1.2. The Contractor has the right to engage third parties to fulfill its obligations under this Agreement without the consent of the Customer.

3.1.3. The Contractor has the right to provide access to information services under this agreement again, if the services were not provided to the Customer within the time periods stipulated by this agreement for reasons beyond the control of the Contractor.

3.2. Rights and obligations of the Customer:

3.2.1. The customer is obliged to pay for the services in the manner, on time and in the amount established by this Agreement.

3.2.2. The Customer is obliged to independently and at his own expense provide himself with the technical means necessary to receive the services provided by the Contractor, and must also have access to the Internet.

4. Cost of the contract and payment procedure

4.1. The cost of information services is set by the Contractor separately for each package of information services and is indicated on the Internet at phuket24.online

4.2. The Customer pays the cost of services under this Agreement by one of the methods provided by the Contractor. Information about the methods and procedure for paying for services under this Agreement is posted by the Customer on websites on the Internet at the addresses phuket24.online

5. Other

5.1. Acceptance of this agreement and full agreement with its terms is the payment by the Customer for the services of the Contractor.

5.2. The Contractor does not return the funds paid under this Agreement in case of refusal of the Customer from the services under this Agreement.

5.3. The Contractor is not responsible for violation of the terms of this Agreement if such violation is caused by force majeure circumstances (force majeure), including: actions of public authorities, fire, flood, earthquake, other natural disasters, lack of electricity and / or computer network failures , strikes, civil unrest, riots, any other circumstances, not limited to those listed, that may affect the performance of the terms of this Agreement by the Contractor and are beyond the control of the Contractor.

6. Responsibility of the Parties

 

6.1. For failure to fulfill or improper fulfillment of obligations under this Agreement, the Parties shall be liable in accordance with the current legislation of the Kingdom of Thailand

6.2. The Contractor is not responsible for the impossibility of providing services under this Agreement for reasons beyond the control of the Contractor, including disruption of communication lines, equipment malfunction, failure to fulfill the obligations of providers of certain services, etc.

7. Validity and modification of the contract

7.1. This Agreement shall enter into force from the moment the Customer fulfills its obligations to pay for services under this Agreement and is valid until the Parties fulfill their obligations.

7.2. The Contractor has the right to make changes to the List of information services provided under this Agreement, the cost and term of their provision by posting the relevant changes on the Internet at the addresses globeestate.net Such changes come into force from the moment they are posted on any of the specified sites.

8. Procedure for resolving disputes

8.1. The Customer agrees and acknowledges that all disputes and disagreements arising between the Parties under this Agreement or in connection with it are resolved in compliance with the mandatory pre-trial dispute resolution procedure. The Customer undertakes to send a written claim on the merits of the dispute to the Contractor.

8.2. If it is impossible to resolve disagreements through negotiations and if a response to the claim sent by the Customer is not received within 30 (thirty) days from the date of its delivery to the Contractor, disputes are subject to judicial review in accordance with the rules on jurisdiction in the manner prescribed by law.
